These Terms of Service govern the use of the Podstata jednoduché formy online store and the purchase of products through our website.
By placing an order, you confirm that you have read and accepted these Terms of Service.

2. Our Products
Podstata jednoduché formy offers handmade abstract sculptures designed primarily for interior spaces.
Our sculptures are handmade in the Czech Republic.
The collection includes pieces inspired by contemporary art, abstract forms and pop-art aesthetics, with an emphasis on strong colours and distinctive visual expression.
Because our products are handmade, individual pieces may contain natural variations in texture, surface, colour or other visual details.
Such characteristics are a natural part of handmade production and do not necessarily constitute a defect.
All sculptures offered through our online store are already completed and available for purchase. We do not produce individual commissioned pieces or modify sculptures according to customer specifications.
3. Product Information
We make reasonable efforts to ensure that product descriptions, photographs, dimensions, colours and other information presented in our online store are accurate.
However, colours displayed on your screen may differ slightly from the actual appearance of a sculpture depending on your device and display settings.
4. Prices
Product prices are displayed in the currency selected by the customer.
The online store may offer prices in CZK, EUR and USD.
The price applicable to an order is the price displayed at the time the order is placed.
Shipping costs are displayed separately during checkout unless the order qualifies for free shipping.
5. Orders
To place an order, the customer selects a product, adds it to the shopping cart and completes the checkout process.
Before submitting an order, the customer has the opportunity to review and correct the information provided.
By submitting an order, the customer makes a binding offer to purchase the selected products.
An order confirmation will be sent to the email address provided by the customer.
6. Conclusion of the Purchase Contract
The purchase contract is concluded when we accept the customer's order.
If a product is unavailable or there is an obvious error in the product information or price, we will contact the customer as soon as reasonably possible and may cancel the affected order.
If payment has already been made, the amount paid will be refunded.
7. Payment
We currently accept:
• payment cards;
• Apple Pay;
• Google Pay.
Payment must be completed during checkout unless another payment method is expressly offered.
8. Delivery
We deliver orders within the Czech Republic, throughout the European Union and to Ukraine.
Czech Republic: 140 CZK, estimated delivery time 1–3 business days.
European Union: 300 CZK, estimated delivery time 5–7 business days.
Ukraine: 300 CZK, estimated delivery time 5–7 business days.
Orders valued at 3,500 CZK or more qualify for free standard shipping.
Delivery times are estimates and may vary depending on the destination and circumstances beyond our reasonable control.
9. Transfer of Risk
The risk of damage to the goods passes to the consumer when the consumer or a third party designated by the consumer, other than the carrier, takes possession of the goods.
This does not affect statutory consumer rights relating to damaged or defective products.
10. Customs and Import Charges
Orders delivered within the European Union are generally not subject to customs duties between EU Member States.
Shipments to Ukraine may be subject to import duties, taxes, customs clearance fees or other charges imposed by the relevant authorities.
Any such charges are the responsibility of the recipient.
11. Right of Withdrawal
If you purchase as a consumer, you generally have the right to withdraw from a distance contract within 14 days without giving a reason.

Nothing in these Terms of Service limits mandatory consumer rights.
12. Complaints and Defective Products
If you receive a defective, damaged or incorrect product, please contact:

Please provide your order number and a description of the issue. Photographs may also help us assess the situation more quickly.
Your statutory rights regarding defective products and complaints remain unaffected.
13. Handmade Nature of Our Products
Our sculptures are handmade art objects.
Materials may naturally contain variations in texture, colour, surface and other characteristics.
Minor differences between product photographs and the actual sculpture therefore do not necessarily constitute a defect.
14. Intellectual Property
All content published in our online store, including photographs, product images, text, logos, graphics, designs and other materials, is protected by applicable intellectual property laws.
Without our prior written permission, such content may not be copied, reproduced, distributed, modified or commercially used.
15. Use of the Online Store
Customers agree to use the online store in accordance with applicable law and not to interfere with its operation or attempt to gain unauthorised access to its systems.
16. Availability of the Online Store
We make reasonable efforts to keep our online store available and functioning properly.
However, we cannot guarantee uninterrupted or error-free availability.
17. Liability
Nothing in these Terms of Service excludes or limits liability that cannot legally be excluded or limited under applicable law.
These Terms of Service do not restrict mandatory consumer rights.
18. Governing Law
These Terms of Service are governed by the laws of the Czech Republic, without prejudice to mandatory consumer protection provisions that may apply under the laws of the consumer's country of residence.
19. Consumer Disputes
If a dispute arises, we encourage customers to contact us first so that we can attempt to resolve the matter directly.
Consumers may also have the right to use statutory alternative dispute resolution mechanisms or other available consumer protection remedies.
20. Changes to These Terms
We may update these Terms of Service from time to time to reflect changes in our business, products, services or legal requirements.
For a particular order, the version of the Terms of Service applicable at the time the purchase contract was concluded will apply.
